Shuffle Photography LLC

These terms apply to all photography, video, digital files, previews, galleries, and delivered media created by Shuffle Photography LLC (“Shuffle Photography,” “Photographer,” “we,” or “us”). By booking services, downloading images, sharing galleries, or using delivered content, the Client agrees to the following terms. Maxwell Ferguson retains creative authorship of all imagery produced under Shuffle Photography LLC in accordance with United States Copyright Law.

1. Copyright Ownership

   • All photographs, video content, edits, and creative works created by Shuffle Photography LLC remain the intellectual property and copyrighted work of Shuffle Photography LLC under United States Copyright Law. Booking photography services does not transfer copyright ownership to the Client. Clients receive a license for personal or approved commercial use, as outlined in the agreement below.

2. Personal Use License

   • Unless otherwise stated in writing, clients are granted a non-exclusive, non-transferable license to: Download and share delivered images, print images for personal use, post images on social media, and share galleries with friends and family.
     Basically, please just enjoy the photos. Print them. Post them. Keep them forever. We just ask that the images are not altered beyond the normal cropping required by social platforms.

3. Social Media & Online Sharing

   • Clients may post images online for personal use, provided that Shuffle Photography LLC is credited whenever reasonably possible. Images are not heavily filtered, altered, or edited. Logos, watermarks, or branding are not removed from previews. A quick tag means a lot. Word of mouth is how most people find us in the first place. Instagram: @authenticallyshuffle

4. Commercial Use

   • Commercial, advertising, publication, resale, sponsored content, vendor marketing, or business-related use requires written permission from Shuffle Photography LLC unless explicitly included in the Client’s agreement.

   • This includes:

     • Brand campaigns

     • Paid advertisements

     • Product packaging

     • Third-party publication

     • Vendor promotional use

     • Magazine/editorial licensing

     • Paid partnerships or sponsored posts

     If you’re unsure whether something counts as commercial use, just ask. Usually, it’s a quick conversation.

5. Image Alteration & Editing

   • Clients may not: Apply heavy filters or AI modifications, remove watermarks, re-edit delivered images, submit images to other editors or photographers for reprocessing, manipulate images in a way that misrepresents Shuffle Photography’s work, or make small crops for social media.

6. RAW Files & Unedited Images

   • RAW files and unedited images remain the property of Shuffle Photography LLC and are not included unless specifically agreed upon in writing. Part of the experience is the editing process itself. That final look matters.

7. Model Release & Portfolio Usage

   • Shuffle Photography LLC may use selected images for: portfolio display, website galleries, social media, blog posts, studio marketing, and educational or promotional purposes. This helps future clients understand the style and feel of the work. Clients may request privacy in writing before their session or event. We genuinely respect that. Website: Shuffle Photography

8. Vendor & Venue Sharing

   • Clients may share images with vendors involved in the event or session, provided that Shuffle Photography LLC is credited. Images are not sold or altered. Vendors do not use images for paid advertising without permission. Honestly, I love it when vendors share the work. It usually means the day went well for everyone involved.

9. Gallery Access & File Storage

   • Online galleries remain active for the timeframe outlined in the Client agreement or gallery delivery email. While Shuffle Photography LLC makes reasonable efforts to archive delivered galleries and files, long-term storage is not guaranteed indefinitely. Clients are responsible for downloading and backing up final images upon delivery. Please back them up. Hard drive, cloud storage, somewhere safe. Future-you will appreciate it.

10. Unauthorized Use

    • Unauthorized reproduction, commercial use, screenshotting watermarked previews, AI training/data scraping, resale, or alteration of images may result in legal action and licensing fees.

11. AI & Machine Learning Restrictions

    • Images created by Shuffle Photography LLC may not be: Uploaded into AI image generators or datasets, used to train machine learning models, manipulated through generative AI systems, or used to create synthetic derivative works without written permission, which includes facial recreation, style replication, or automated image generation based on delivered work.

12. Limitation of Liability

    • Shuffle Photography LLC is not responsible for: Printing quality from third-party labs, social media compression, unauthorized screenshotting or reposting by third parties, File corruption after delivery, missed shots due to restrictions, lateness, weather, venue rules, or circumstances beyond reasonable control. We’ll always do everything we can to protect the experience and the work. But sometimes real life happens.

13. Agreement & Acceptance

    • Payment of the invoice, signed contracts, gallery downloads, or continued use of the delivered images constitute acceptance of these Rights & Usage Terms.
